A Tibit Part II
Last Wednesday I asked to
have our Village attorney find out if the statute 82.108b found in Chapter 82 of
the Condominium Act is not being fully complied with, will it impede in any way
with our owner’s rights.
This relatively new 2012 governing statute is clear that while in an executive meeting any business a director wishes to consider must involve six and only six categories. It adds that before any executive meeting a board must announce to owners the general nature of any business consideration involving these categories.
Since 2012 the minutes show
every Regular Monthly Meeting but one had an executive meeting, yet we find only
one instance where our Directors announced to owners their business considerations.
Why is that? The Board let owners know what they were going to be discussing
behind closed doors once, why not every time as the law seemingly requires. We will
see what the attorney says.
